Prop 8 Declared Unconstitutional

Court Clerks Pass Out Copies of Prop 8 Ruling.

I went to the courthouse to hear the decision on Prop 8 case this morning. I’ve missed several of these historic moments, and since the courthouse is right around the corner, I decided to trek over to watch history being made.

In a 2-1 ruling, the Ninth U.S. Circuit Court of Appeals in San Francisco said Proposition 8′s limitations on access to marriage took rights away from a vulnerable minority without benefiting parents, children or the marital institution.

“Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples,” said Judge Stephen Reinhardt in the majority opinion.

“The Constitution simply does not allow for laws of this sort.”

The crowd assembled was 100% in favor of Marriage Equality. Opponents are going deeper and deeper underground because they know tide of opinion is turning against them, but they persist fervently. The battle over merely making the tapes of the trial public shows they don’t want their faces shown. That’s what makes it so insidious.
